So true you can remake that game in your own engine but you can't tell the same story or even use the name of the characters you yourself made which means you have changed everything about your story which ruins the point. But now if you had a singleplayer story base campaign made you'd be totally screwed since the story you made would now belong to Blizz. Dota got lucky getting away since only important reason people played Dota was gameplay, not aesthetics or story.
